Clients will sometimes call our office after a serious injury and ask, “What is a negligent security case, and do I have a valid claim?” Negligent security refers to an injury you sustained from a malicious attack that could have been prevented if the premises on which the assault took place had adequate security. For example, if you are robbed and assaulted in the parking lot of a store that is known to have a high crime rate, you have a valid negligent security claim.
Of course, like all cases, there are many factors at play. A store or establishment in an area that is a hotbed for criminal activity requires a security guard to be employed and on-duty at times when the crime rate is highest. The business owner is required to protect their patrons and not leave them at risk of injury. If the security guard is negligent in doing their duty — or if there never was a security guard to begin with — the responsibility will fall upon the property owner.
