Criminal Mischief in the First Degree
- Criminal mischief in the first degree is a Class B felony.
- It is a serious, violent felony, punishable by up to 25 years in jail.
- When a person damages the property of another by means of an explosive device, the charge is criminal mischief in the first degree.
Criminal Mischief in the Second Degree
- Criminal mischief in the second degree is a Class D felony offense punishable by up to seven years in a state penitentiary.
- If you damage another person’s property and the damaged property is valued above $500, the offense is referred to as criminal mischief in the second degree.
Criminal Mischief in the Fourth Degree
- A charge of criminal mischief in the fourth degree is a Class A misdemeanor, a criminal offense.
- If convicted, the sentence could be one to three years in jail, and/or a fine.
- Criminal mischief occurs when you intentionally damage another person’s property and can also be described as recklessly damaging another’s property.
